Ferdinand Waititu Applies for Bail Review, Seeks Reduction to KSh20 Million

Former Kiambu Governor Ferdinand Waititu has filed an application in court requesting a review of his existing bail conditions, which require a KSh53.5 million bank guarantee.
Through his legal team, Waititu argued that he has been unable to secure the necessary bank guarantee despite seven months passing since the bail was granted in 2025. His lawyers emphasized his consistent compliance with court appearances, asserting that he poses no flight risk and that the current terms have become unreasonable and impractical to fulfill.
The defense proposed lowering the bail amount to KSh20 million in cash or allowing alternative security such as title deeds for land or motor vehicles of equivalent value. They urged the court to exercise its discretion in favor of the applicant, highlighting Waititu's ongoing challenges in meeting the original requirement while he remains compliant and attends all sessions.
The prosecution, led by State Counsel Mwamburi representing the Director of Public Prosecutions, strongly opposed the application. They contended that Waititu has failed to demonstrate new or compelling circumstances warranting a review, describing his shifting requests as lacking sufficient substance. The court heard submissions from both sides and is set to deliver its ruling on February 18, 2026.
