High Court Awards Blogger Ndiang’ui Kinyagia KSh5 Million Over Unlawful Police Raid

The High Court has awarded blogger and tech entrepreneur Ndiang’ui Kinyagia KSh5 million after ruling that police unlawfully raided his home in Kinoo during investigations linked to the June 2025 protests.
In a judgment delivered on Tuesday, September 22, 2026, Justice Patricia Nyaundi found that DCI officers entered Kinyagia’s residence, conducted a search, and seized his property without lawful authority
The court held that the actions violated Kinyagia’s constitutional rights, including his rights to privacy, property, dignity, security of the person, and freedom of movement.
Justice Nyaundi said the officers had “invaded, searched, and seized” before attempting to give their actions the appearance of legality.
As part of the orders, the DCI and Inspector General of Police Douglas Kanja were directed to jointly pay Kinyagia KSh5 million in general damages, in addition to interest and the costs of the case.
The court further barred the Director of Public Prosecutions (DPP) from prosecuting Kinyagia on the basis of the investigative process that the court found unconstitutional.
Kinyagia came under investigation in June 2025 over social media activity allegedly linked to the June 25 protests, including a protest timetable that circulated widely online.
He subsequently went into hiding, later appearing at the Milimani Law Courts in July 2025, where he said he had feared for his safety.
The ruling now brings a major legal development in his challenge to the conduct of the police investigation and the raid on his home.
