Court Rules Kenya's General Election Should Be Held Next Tuesday.
In a landmark decision that has sent ripples through the political landscape, the Malindi High Court has declared any presidential election scheduled for August 2027 null and void.
Justice Mugure Thande ruled that the Independent Electoral and Boundaries Commission would be acting against the Constitution by organising the polls on 10 August 2027. The judgment emphasises that the election date fixed by the Constitution must take priority over the length of a presidential term.
The court determined that presidential elections are required to take place in the fifth year after the previous vote, not after a full five years have elapsed. Justice Thande stated, “A Declaration is hereby made that holding the next presidential election on any date other than the second Tuesday in August 2026 will violate and contravene Articles 2, 3, 10, 136(1) & (2)(a), 142(1), 24, 25(1) & (5) of the Constitution, and will consequently be null and void.” She further clarified that the correct date under Article 136(2)(a) is 11 August 2026.
Petitioners had successfully argued that because the last presidential election occurred on 9 August 2022, the next one must fall on the second Tuesday of August in the fifth year, which is 2026. After reviewing relevant constitutional provisions, including Articles 136, 142 and 259, the judge agreed that the Constitution does not guarantee the Head of State a complete five-year term before fresh elections can be held.
Although the ruling points to an election next week, Justice Thande suspended the order, leaving the immediate practical effects on hold. The decision challenges the long-held assumption that the current term would run uninterrupted until 2027 and places the electoral calendar under fresh scrutiny.
The judgment has intensified debate over constitutional interpretation and the precise timing of national polls in the country. While the suspension provides temporary breathing space, the clear declaration that a 2027 presidential election would be unconstitutional sets the stage for further legal and political developments in the coming days.
