LSK warns against postponing Ol Kalou by-election.

The Law Society of Kenya has issued a strong call for upholding the scheduled Ol Kalou by-election without delay, emphasizing that postponement should only be a last resort under clear constitutional guidelines.

Society leaders argue that voters deserve the chance to choose their representative on the set date, rather than facing disenfranchisement due to the actions of a few. They stress that existing laws provide sufficient tools to punish those who break electoral rules, including through investigations, prosecutions, and disqualifications

Concerns have grown over reports of misuse of state resources, public funds, and government programs to influence voters during the campaign period. The LSK highlighted issues such as voter inducement with cash and goods, involvement of public officers in partisan activities, and instances of intimidation or threats. President Charles Kanjama noted that these behaviors undermine fair competition and called on relevant agencies like the DCI, ODPP, and EACC to act swiftly and impartially against any offenders.

The society condemned all forms of violence, inflammatory language, and attempts to suppress political participation, reminding everyone that democratic rights to assemble and express views must be respected in a peaceful environment. They view the by-election as a crucial test for the country's electoral system ahead of larger polls in 2027. To support transparency, the LSK plans to deploy independent observers to monitor the process and gather insights for future improvements in election management.

As campaigns wind down, this stance from legal experts reinforces the need for accountability while protecting the integrity of the vote. Political players and institutions are urged to focus on issue-based competition and adhere strictly to the law. Observers hope that decisive enforcement during this by-election will build greater public trust in Kenya's democratic processes moving forward.
