High Court Grants Ferdinand Waititu Bail Reprieve, Reduces Terms to Ksh 20 Million Cash

Former Kiambu Governor Ferdinand Waititu has received a significant reprieve after the High Court reduced his bail conditions pending appeal in a major corruption case.

On February 18, 2026, Justice Winfrida Okwany granted his application to review the earlier terms, which had required a Ksh 53.5 million bank guarantee that he was unable to secure for over seven months. The new bail is set at Ksh 20 million in cash, or alternatively, two sureties backed by property securities valued at no less than Ksh 30 million each, subject to verification by the Deputy Registrar. Waititu must also deposit his passport with the court until his appeal is determined.

The ruling stems from Waititu's conviction in a Ksh 588 million graft scandal involving abuse of office and conflict of interest during his tenure, where he allegedly awarded a county road tender irregularly to a company linked to him and associates. Despite being granted bail in July 2025, compliance issues kept him detained at Kamiti Maximum Security Prison. His defense argued he had consistently attended court, posed no flight risk, and the original terms were unreasonable, while the prosecution opposed the review, claiming insufficient grounds.

This decision paves the way for Waititu's potential release after nearly a year in custody, with the matter set for further submissions later this month as his appeal proceeds.
