Busia Man Sues Governor for Ksh100 Million Over Alleged Brutal Assault

A 31-year-old boda boda rider from Busia County has filed a high-stakes lawsuit demanding Ksh100 million in damages from Governor Paul Otuoma, accusing him of an unprovoked physical assault that has left him fearing for his life.

Yusuf Suleiman Hamisi claims the incident occurred on March 6, 2026, at Bukri Market in Funyula Constituency during a county-organized event for distributing certified maize seeds. While standing peacefully in the queue, Hamisi alleges that the governor suddenly kicked him hard in the groin without any provocation or warning, an act witnessed by several members of the public and captured on video that quickly spread across social media platforms.

Following the alleged assault, Hamisi says he faced further intimidation and obstruction when seeking medical attention at Sioport and Ruambo Sub-County hospitals, with interference he links directly to the governor’s office. He reported the matter at Sioport Police Station, but soon afterward began receiving threats, including visits by unknown individuals to his home demanding he drop the complaint. In a dramatic twist, Hamisi claims he was briefly abducted before managing to escape and go into hiding for his safety. Through his lawyer Danstan Omari, he has petitioned the Milimani High Court, arguing that Governor Otuoma’s actions violated his constitutional rights to dignity, personal security, equality, and fair administrative action, while also breaching standards of leadership and integrity under Chapter Six of the Constitution and the Leadership and Integrity Act.

In the petition, Hamisi is not only seeking monetary compensation but also far-reaching orders, including a declaration that the governor is unfit to hold public office, directives for investigative agencies to probe the matter, instructions for the Busia County Assembly to commence impeachment proceedings under Article 181, and provisions for his personal security and proper medical care. The case has sparked public debate on accountability for elected leaders and the protection of ordinary citizens’ rights in Kenya, with many awaiting the governor’s response and the court’s determination on whether such serious allegations of gross misconduct can be substantiated.
